El artículo realiza un análisis sobre los elementos, características y estructura de las normas jurídicas, cuyo conocimiento resulta esencial por el papel relevante que tienen en la aplicación del Derecho en los casos concretos, con énfasis en la materia de propiedad intelectual. Además, incluye la confrontación doctrinal consistente en que la elección correcta de un bien jurídico no siempre se corresponde con el mejor beneficio o consecuencia establecida en la hipótesis legal, en relaciones jurídicas bilaterales, a la luz de la Teoría de Juegos, a no ser que se procure un punto intermedio, como lo establece la tesis acerca del Equilibrio de Nash.

The article analyzes the elements, characteristics and structure of legal rules, which knowledge is essential for the important role they have in the application of law in specific cases, with an emphasis on intellectual property. It also includes the confrontation in which the right choice not always corresponds to the best benefit or consequence established in the legal hypothesis, in bilateral legal relations, in accordance with the Game Theory, unless that it tries an intermediate point, as established by the thesis about Nash Equilibrium.
