La figura del Juez en la Escuela de la Exégesis

La figura del juez y el papel que debe desempeñar en el sistema legal obedece a concepciones filosóficas, políticas y culturales, con un profundo arraigo en el pensamiento racional que caracterizó a la Modernidad. Para entender la actualidad del juez en la posmodernidad y su devenir histórico, en estas líneas se hace especial referencia a la figura del juez en el siglo XVIII, bajo el esquema de la Escuela de la Exégesis Francesa, ya que se considera a esta época y al panorama que la cobijó, como el parteaguas o génesis de la concepción de la función jurisdiccional, ejemplificada en el silogismo judicial concebido por el racionalismo jurídico que caracteriza a la administración de justicia del Estado Moderno.

The figure of the judge and the role it should play in the legal system obeys philosophical, political and cultural concepts, with deep roots in rational thinking that characterized modernity. To understand today the judge in the postmodernism and its historical development in these lines special reference to the figure of the judge in the eighteenth century, under the scheme School French exegesis is done, as it is considered to this time and the panorama that the shelter it, as the watershed or genesis of the conception of the judicial function exemplified in the judicial syllogism conceived by the legal rationalism that characterizes the administration of justice of the Modern State.
